  42.         S 101.  Definitions
  43.         
  44. As used in this title [17 USC SS 101 et seq.], the following 
  45. terms and their variant forms mean the following:
  46.  
  47. An "anonymous work" is a work on the copies or phonorecords of
  48. which no natural person is identified as author.
  49.  
  50. An "architectural work" is the design of a building as embodied 
  51. in any tangible medium of expression, including a building, 
  52. architectural plans, or drawings. The work includes the overall 
  53. form as well as the arrangement and composition of spaces and 
  54. elements in the design, but does not include individual standard 
  55. features
  56.         
  57. "Audiovisual works" are works that consist of a series of related
  58. images which are intrinsically intended to be shown by the use of
  59. machines or devices such as projectors, viewers, or electronic
  60. equipment, together with accompanying sounds, if any, regardless
  61. of the nature of the material objects, such as films or tapes, in
  62. which the works are embodied.
  63.         
  64. The "best edition" of a work is the edition, published in the
  65. United States at any time before the date of deposit, that the
  66. Library of Congress determines to be most suitable for its
  67. purposes.
  68.  
  69. The "Berne Convention" is the Convention for the Protection of 
  70. Literary and Artistic Works, signed at Berne, Switzerland, on 
  71. September 9, 1886, and all acts, protocols, and  revisions 
  72. thereto.
  73.  
  74. A work is a "Berne Convention work" if--
  75.  
  76.     (1) in the case of an unpublished work, one or more of the 
  77. authors is a national of a nation adhering to the Berne 
  78. Convention, or in the case of a published work, one or more of the 
  79. authors is a national of a nation adhering to the Berne 
  80. Convention on the date of first publication;
  81.  
  82.     (2) the work was first published in a nation adhering to the 
  83. Berne Convention, or was simultaneously first published in a 
  84. nation adhering to the Berne Convention and in a foreign nation 
  85. that does not adhere to the Berne Convention;
  86.  
  87.     (3) in the case of an audiovisual work--
  88.  
  89.           (A) if one of more of the authors is a legal 
  90. entity,that author has its headquarters in a nation adhering to 
  91. the Berne Convention; or
  92.  
  93.           (B) if one or more of the authors is an individual, 
  94. that author is domiciled, or has his or her habitual residence 
  95. in, a nation adhering to the Berne Convention;
  96.  
  97. (4) in the case of pictorial, graphic, or sculptural work that is 
  98. incorporated in a building or other structure, the building or 
  99. structure, the building or structure is located in a nation 
  100. adhering to the Berne Convention;
  101.  
  102. (5) in the case of an architectural work embodied in a building, 
  103. such building is erected in a country adhering to the Berne 
  104. Convention.
  105.  
  106. For purposes of paragraph (1), an author who is domiciled in or 
  107. has his or her habitual residence in, a nation adhering to the 
  108. Berne Convention is considered to be a national of that nation. For 
  109. purposes of paragraph (2), a work is considered to have been 
  110. simultaneously published in two or more nation if its dates of 
  111. publication are within 30 days of one another.
  112.  
  113. A person's "children" are that person's immediate offspring,
  114. whether legitimate or not, and any children legally adopted by
  115. that person.
  116.         
  117. A "collective work" is a work, such as a periodical issue,
  118. anthology, or encyclopedia, in which a number of contributions,
  119. constituting separate and independent works in themselves, are
  120. assembled into a collective whole.
  121.         
  122. A "compilation" is a work formed by the collection and assembling
  123. of preexisting materials or of data that are selected,
  124. coordinated, or arranged in such a way that the resulting work as
  125. a  whole constitutes an original work of authorship. The term
  126. "compilation" includes collective works.
  127.  
  128. A "computer program" is a set of statements or instructions to be 
  129. used directly or indirectly in a computer in order to bring about 
  130. a certain result.
  131.         
  132. "Copies" are material objects, other than phonorecords, in which
  133. a work is fixed by any method now known or later developed, and
  134. from  which the work can be perceived, reproduced,  or  otherwise 
  135. communicated,  either  directly or with the aid of a  machine  or 
  136. device.   The term "copies" includes the material  object,  other 
  137. than a phonorecord, in which the work is first fixed.
  138.         
  139. "Copyright  owner",  with  respect to any one  of  the  exclusive 
  140. rights  comprised  in a copyright, refers to the  owner  of  that 
  141. particular right.
  142.         
  143. A work is "created" when it is fixed in a copy or phonorecord for 
  144. the first time; where a work is prepared over a period of time, 
  145. the portion of it that has been fixed at any particular time  
  146. constitutes the work as of that time, and where the work has been 
  147. prepared in different versions, each version constitutes a 
  148. separate work.
  149.  
  150. The "country of origin" of a Berne Convention work, for purposes of 
  151. section 411, is the United States if--
  152.  
  153. (1) in  the case of a published work, the work is first 
  154. published--
  155.  
  156.      (A) in the United States;
  157.  
  158.      (B) simultaneously in the United States and another nation or 
  159. nations adhering to the Berne Convention, who law grants a term of 
  160. copyright protection that is the same or longer than the term 
  161. provided in the United States;
  162.  
  163.      (C) simultaneously in the United States and a foreign nation 
  164. that does not adhere to the Berne Convention; or
  165.  
  166.      (D) in a foreign nation that does not adhere to the Berne 
  167. Convention, and all of the authors of the work are national, 
  168. domicilaries, or habitual resident of,or in the case of an 
  169. audiovisual work legal entities with headquarters in, the United 
  170. States; or
  171.  
  172. (2) in the case of an unpublished work, all the authors of the 
  173. work are nationals, domiciliaries, or habitual residents of the 
  174. United States, or in the case of an unpublished audiovisual work, 
  175. all authors are legal entities with headquarters in the United 
  176. States; or,
  177.  
  178. (3) in the case of a pictorial, graphic, or sculptural work 
  179. incorporated in a building or structure is located in the United 
  180. States.
  181.  
  182. For the purposes of section411, the "country of origin" of nay 
  183. other Berne Convention work is not the United States.

  185. A "derivative work" is a work based upon one or more preexisting 
  186. works, such as a translation, musical arrangement, dramatization, 
  187. fictionalization,  motion picture version, sound recording, art 
  188. reprodu
